1. ACCEPTANCE OF TERMS
SHAMMIESWORLD provides a collection of online resources, including classified ads for new and gently used pet gear, supply, and services, (referred to hereafter as "the Service") which is subject to the following Terms of Service ("TOS"). By using the Service in any manner, you agree to comply with the TOS. Also, when using certain SHAMMIESWORLD you agree to follow any applicable posted rules or guidelines for all SHAMMIESWORLD services, which may be subject to change at any time. If you have any objections to any term or condition of the TOS, any rules or guidelines, or any subsequent changes thereto or become dissatisfied with SHAMMIESWORLD in any manner, your only recourse is to discontinue use of SHAMMIESWORLD immediately.
2. MODIFICATIONS TO THESE TERMS
We reserve the right, at our sole discretion, to modify, alter, or otherwise change these terms and conditions at any moment. Such changes shall become effective immediately thereof upon posting. You have to review this agreement on a regular basis to be aware of any modifications.
3. MEMBERSHIP OBLIGATIONS
In accordance to your use of the Service, you agree that: (a) you are at least 18 years of age (b) you provide accurate, current and true information about yourself as indicated in the membership form. If you provide any information that is inaccurate, untrue, and not current or SHAMMIESWORLD has legitimate grounds to suspect that any such information is inaccurate, untrue, or not current, SHAMMIESWORLD reserve the right to suspend or terminate your account at any time.
4. MEMBERSHIP ACCOUNT AND PASSWORD
Upon registering, you will receive a password and account designation upon completing the Service's membership process. It is your responsibility to maintain the confidentiality of your password and account, and is fully responsible for all activities under that password and account. It is your responsibility to contact SHAMMIESWORLD of any unauthorized use of your password or account or any breach of security. SHAMMIESWORLD cannot and will not be liable for any loss or damage arising from your failure to comply.
5. CONTENT SUBMITTED
You agree that all postings, text, photos, messages, files, or any other materials ("Content") posted on, or transmitted from our Service, are considered the sole responsibility of the person in which the Content was originated. Moreover, it means that you assume full responsibility for the ("Item") of Content that you post, transmit or via the Service. You understand that SHAMMIESWORLD is not responsible for Content displayed through the Service. Also, you are aware that by using the Service, you may come across indecent, offensive, or otherwise disagreeable. The Content available through the Service may be linked to other websites, which are independent of SHAMMIESWORLD. We do not represent or warrant its authenticity to the information on the site. Your decision to link on to that page is at your own risk. You understand and are aware of the risks associated with such Content, and under no circumstances will SHAMMIESWORLD be held liable for any Content and/ or any damages that may occur due to the Content. You acknowledge that SHAMMIESWORLD does not pre-screen or qualify Content, but that SHAMMIESWORLD has the right to refuse, or delete any Content that is in the Service, for conflicting or violating the conditions of the TOS or for any other reason.
6. INDEMNIFY
You agree to indemnify and hold SHAMMIESWORLD, its agents, officers, subsidiaries, affiliates, officers, directors, officers, employees, or partners harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to arising out of Content you submit, post, exchange, or made available through the Service, your use of the Service, your violation to the TOS, your breach of any of the warranties and representations herein, or your violation of any rights of another.
7. CONDUCT
You are aware that all information, messages, text, photographs, data or any other material ("Content"), regardless of whether it is posted or privately transmitted, are the sole responsibility of the person who generated such Content. This states that you, and not SHAMMIESWORLD, are completely responsible for all Content that you post, email, upload, transmit or otherwise make available using the Service.
SHAMMIESWORLD does not manage the Content posted via the Service and, as such, we do guarantee the integrity or quality of such Content. You are aware that by using the Service, you may be exposed to Content that you may find offensive, or indecent. So, under no circumstances will SHAMMIESWORLD be liable in any manner for any Content or for any loss or damage of any kind as a result of the use of any Content posted, transmitted, emailed or made available via the Service. Please note that SHAMMIESWORLD does not promote or support the abuse of animal cruelty.
You agree not to post, email or otherwise make available Content:
a. unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, libelous, invasive of another's privacy, or is harmful to minors in any way
b. that impersonates any person or entity, including,
but not limited to, a SHAMMIESWORLD employee, or falsely claim or otherwise misrepresents your affiliation with a person or entity
c. manipulate identifiers or forge headers for the purpose of disguising the origin of any Content that is transmitted through the Service
d. that you do not own the right to make available under law, under obligation, under contractual, or fiduciary relationships ( this includes, but limited to inside information, confidential or proprietary information obtained or disclosed as part of employment relationships or under a nondisclosure agreements)
e. that infringes any patent, trade secret, copyright, trademark or other proprietary rights ("Rights") of any party
f. that is unsolicited or unauthorized promotional materials, or advertisement, "chain letters," "junk mail," "spam," or any other method of solicitation
g. that contains malicious software viruses or any other compute code, program or files intended to destroy or interrupt the functionality of any computer or telecommunication equipment
h. "stalk" or "harass" any other
i. that with or without malice violate any applicable local, state, national or international law, including, but not limited to regulations by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the American Stock Exchange, the New York Stock Exchange or the NASDAQ, and any other regulations having the force of law
j. store or collect personal data about any other users.
You are aware and acknowledge that SHAMMIESWORLD and its designee have the right to remove any Content that violates the TOS or is otherwise objectionable. You are aware and agree that you are required to evaluate, and bear all risks associated with, the use of any and all Content, including any relevance on its accuracy, or usefulness of such Content. In this manner, you agree that you may not rely on any Content produced by SHAMMIESWORLD or submitted to us, including but not limited to information in SHAMMIESWORLD.
You agree and acknowledge that SHAMMIESWORLD may disclose or preserve the Content if required to do so by the law or in good faith believe that such disclosure is reasonable necessary to: (a) enforce the TOS; (b) comply with legal process; (c) protect the rights, personal safety, or property of SHAMMIESWORLD, its users and the public; (d) respond to claims that any Content violates the rights of third-parties.
You are aware that the transmission of the Service of technical exchange of the Service, including your Content, may be done through (a) network transmission; (b) updated changes to meet technical requirements.
8. INTERNATIONAL USE
You agree to comply with all local and state rules regarding online code of conduct and acceptable Content. Moreover, you agree to comply with all applicable laws in regards to the transmission of data exported from the United States or the country or county in which you reside.
9. MODIFICATIONS TO THIS AGREEMENT
SHAMMIESWORLD reserves the right, at any time to modify or change these terms and conditions. You understand that such modifications shall become effective immediately upon the updates thereof. You are required to review this on a regular basis to keep yourself updated of any changes.
10. ADVERTISERS
Your transaction, participation, or correspondence with advertisers found through the Service, including delivery of related goods and services, payments, or any other form of representations associated to such dealings, are strictly between you and the involved advertiser. You agree that SHAMMIESWORLD shall not be liable or responsible for any damage or loss incurred as a result of any such dealings with such advertisers on the Service.
11. TERMINATION
You agree that SHAMMIESWORLD, in its sole discretion, may remove or terminate your password, use of the Service, or your account, and discard any Content within the Service, for any reasons, but not limited to any violations of the TOS. SHAMMIESWORLD, at its sole discretion or at any time discontinue providing the Service, with or without notice. You agree that the termination of your access to the Service under any section of the TOS may be changed without prior notice, and you agree that SHAMMIESWORLD may immediately deactivate or delete your account and all related data to such files or the Service.
Furthermore, you agree that SHAMMIESWORLD shall not be liable to you or any other third-party for the cancellation of your access to the Service.
12. LINKS
The Service may provide, or third-parties may provide, links to other sites or resources in which SHAMMIESWORLD has not control over such sites and resources. You agree and acknowledge SHAMMIESWORLD is not responsible for such sites, nor we endorse or are liable for any Content, product, advertising or other materials available on such site. You further agree and acknowledge that SHAMMIESWORLD shall not be deemed liable for any damage or loss caused by or in connection with use of any such Content, goods or services on or through any such site.
13. PROPRIETARY RIGHTS
You agree and acknowledge that the Service and any necessary software used along with the Service such as ("Software") contain proprietary and confidential information that is protected by appropriate intellectual property and other laws. You are aware and agree that Content contained in sponsor advertisements presented to you through the Service or advertisers is protected by patents, copyrights, trademarks, or other proprietary rights and laws. This is an exception if expressed by SHAMMIESWORLD or advertisers, you agree not to change, rent, loan, sell, share or create derivative works based on the Service of the Software, in part or in whole.
SHAMMIESWORLD gives you a personal, non-transferable and non-exclusive right and license to use the object code on a single computer; providing that you do not (not allowing third party to) change, copy, modify, reverser assemble, reverse engineer or otherwise attempt to discover any source code, sublicense, sell, assign, share a security interests in or otherwise share any right in the Software. You agree not to change the Software in any fashion or form, or to use the modified versions of the Software, including but not limited to the purpose of obtaining unauthorized access to the Service. You agree that you will not access the Service by any other means other than through the interface that is provided on SHAMMIESWORLD for use in accessing the Service.
14. NOTICE
Notices to you are made available via email or regular mail. The Service may also provide notices of changes to the TOS or other issues by displaying notices, updates or links to notice to you mainly on the Service.
15. LIMITATION OF LIABILITY
YOU AGREE AND ARE AWARE THAT Shammiesworld SHALL NOT BE LIABLE FOR ANY INCIDENTAL, DIRECT, INDIRECT, CONSEQUENTIAL, OR DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR OTHER INTANGIBLE LOSSES (ALTHOUGH YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). RESULTING FROM (i) THE USE OR INABILITY TO USE THE SERVICE (ii) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE (iii) UNAUTHORIZED ACCESS TO OR MODIFICATIONS OF YOUR TRANSMISSIONS OR DATA (iv) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY INFORMATION, GOODS, OR SERVICES PURCHASED OR RECEIVED OR MESSAGES OBTAINED OR TRANSACTION THROUGH OR FROM THE SERVICE; OR (v) ANY OTHER MATTER PERTAINING TO THE SERVICE.
16. DISCLAIMER OF WARRANTIES
YOU AGREE AND ARE AWARE THAT:
a. YOUR USE OF THIS SERVICE IS AT YOUR OWN RISK. THE SERVICE IS "AS IS" AND ON AN "AS AVAILABLE" BASIS. Shammiesworld DISCLAIMS ALL WARRANTIES OF ANY MANNER, WHETHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
b. NO ADVICE OR INFORMATION, ORAL OR WRITTEN, OBTAINED BY YOU FROM Shammiesworld OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS.
c. Shammiesworld MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE SECURE, UNINTERRUPTED, OR TIMELY, (iii) THE RESULTS THAT MAY BE TAKEN FROM THE USE OF THE SERVICE WILL BE RELIABLE, AND (iv) ANY ERRORS IN THE SOFTWARE WILL BE RESOLVED.
d. ANY MATERIAL DOWNLOADED OR OBTAINED THROUGH THE USE OF THE SERVICES IS DONE AT YOUR OWN RISK AND THAT YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEMS OR LOSS OF DATA THAT MAY RESULT FROM DOWNLOADING OF SUCH MATERIAL.
17. TRADEMARK INFORMATION
SHAMMIESWORLD.COM, the logo, trademarks and service marks, and any other SHAMMIESWORLD logos and product and service names are the trademarks of SHAMMIESWORLD.COM. Without the consent and permission of SHAMMIESWORLD.COM, you agree that you will not display or use in any way, the SHAMMIESWORLD.COM marks.
18. GENERAL INFORMATION
The TOS constitutes the entire agreement between you and SHAMMIESWORLD and govern your use of the Service, superseding any prior agreements between you and SHAMMIESWORLD. The TOS and the relationship between you and SHAMMIESWORLD shall be governed by the laws of the State of California without regard to its conflict of law provisions. You and SHAMMIESWORLD agree to provide to the personal and exclusive jurisdiction of the courts located within the county of Alameda, California. The failure or lack of SHAMMIESWORLD to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such provision or right. If any provision of the TOS is found by court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as indicated in the provision, and the other provisions of the TOS remain in full effort. You agree that regardless of any statute or law to the contrary, any complaints, claims or cause of action brought forth or related to use of the Service or the TOS must filed within one (1) year after such claim or cause of action arose or be favored barred.
